These general terms and conditions of sale apply to all orders placed on the website www.duterneracingparts.com

The applicable GTCS are those in effect on the day the order is validated.

Product Availability

Our product and price offers are valid as long as they are visible on the site.

The photos are not contractual. Please contact us for more information.

Article 3:

Order Validation and Electronic Signature (Law of March 13, 2000 on electronic signatures)

Any order form signed by the consumer through a “double click” constitutes an irrevocable acceptance that can only be disputed within the limits provided in these general terms and conditions of sale.

The “double click” associated with the authentication and non-repudiation procedure and the protection of message integrity constitutes an electronic signature. This electronic signature has the same value between the parties as a handwritten signature.

Payment Default

duterneracingparts.com reserves the right to refuse to make a delivery or honor an order from a consumer who has not fully or partially settled a previous order or with whom a payment dispute is being administered.

Article 5:

Shipping and Delivery

All our packages are shipped in France by GLS and abroad by Colissimo. Delivery times are usually 2 to 5 business days from the date of processing your order.
If the delivery time proves to be longer, you will be automatically notified of the new timeline.

Upon delivery by the GLS carrier:

– Professional customers must compulsorily affix their commercial stamp and their signature on the delivery slip

– Private customers must sign and write their identity card number, license or passport on the delivery slip.

In case of dispute or non-delivery, no credit will be offered if these conditions are not met.

The client must verify in the presence of the delivery person that the package has not been damaged or opened. If it appears that the package has been damaged or opened, the client must make reservations with the delivery person and refuse the package. No credit will be made for damages found after delivery.

Article 6:

Force Majeure

DUTERNERACINGPARTS cannot be held responsible for non-performance of the concluded contract due to the occurrence of a force majeure event.

Regarding products purchased to meet professional needs, duterneracingparts.com will not incur any liability for any indirect damages resulting from these presents, operating loss, loss of profit, damages or expenses that may arise.

Article 7:

Withdrawal and Refund Policy

To properly process your request, please remind us of your order number and your full contact details.

In accordance with the Hamon law of June 2014, you have a period of 14 working days from the delivery date of your order to return any item that does not suit you, in its original packaging and in good condition, suitable for re-marketing, and request an exchange or refund without penalty, except for return costs.

You can only return your order after requesting a return form by mail. (to be attached with the return)

In case of exchange (e.g., size issue), a flat rate of 12 euros including VAT per package will be charged.

Reimbursement will be made within a maximum of 15 days to your bank card, via your PayPal account, by check or bank transfer depending on the payment method used when ordering.

Article 8:

Warranty and After-Sales Service

Generalities

All products marketed by duterneracingparts.com are intended for use in motorcycle racing on closed tracks. Therefore, Duterneracingparts grants no warranty to all these products.

Manufacturer Warranty

Some products, however, benefit from a Manufacturer Warranty. The duration of this warranty is displayed at the bottom of the product sheet. The manufacturer’s warranty terms for the product will be indicated on the notice included with it.

Disputes

Any dispute must be reported by email to contact@duterneracingparts.com

We will then contact you to resolve this issue in accordance with the Hamon law of March 17, 2014 (law number 2014 344).
